Welcome to Whisper Dictator. By downloading, installing, or using our software, you agree to be bound by these Terms of Use. Please read them carefully.

1. Acceptance of Terms

By accessing or using Whisper Dictator, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, do not use the software.

2. Description of Service

Whisper Dictator is a desktop application that provides offline speech-to-text transcription using the Whisper AI model. The software runs entirely on your local machine and does not transmit audio data to external servers.

3. License Grant

Free License

The free version grants you a limited, non-exclusive, non-transferable license to:

• Use the software for up to 7 transcriptions per day
• Access all features of the application
• Install and use on one (1) device

Paid License (Annual/Lifetime)

Paid licenses grant you a non-exclusive, non-transferable license to:

• Use the software without transcription limits
• Install on up to 2 devices (Annual) or 3 devices (Lifetime)
• Receive priority support
• Receive software updates during the license period

License Restrictions

You may NOT:

• Share, sell, or transfer your license key to others
• Reverse engineer, decompile, or disassemble the software
• Remove or modify any copyright notices
• Use the software for any illegal purpose
• Attempt to circumvent license validation mechanisms

4. Intellectual Property

Whisper Dictator and its original content, features, and functionality are owned by sincronia.digital and are protected by international copyright, trademark, and other intellectual property laws.

The Whisper AI model is developed by OpenAI and used under their license terms. We utilize whisper.cpp, an open-source implementation by Georgi Gerganov.

5. Payment and Refunds

Payment Processing

All payments are processed securely through Stripe. We do not store your complete credit card information on our servers.

Pricing

• Free: $0 (7 transcriptions/day)
• Annual: $39.99/year (unlimited, 2 devices)
• Lifetime: $99 one-time (unlimited, 3 devices)

Refund Policy

We offer a 14-day money-back guarantee for all paid licenses. If you're not satisfied, contact us within 14 days of purchase for a full refund.

Refunds are not available after 14 days or if we detect abuse of the refund policy.

Subscription Renewal

Annual licenses do not auto-renew. You will receive an email reminder before your license expires.

6. Device Activation

Licenses are validated using a unique device fingerprint generated from your hardware. Each license type has a device limit:

• Annual: Up to 2 devices simultaneously
• Lifetime: Up to 3 devices simultaneously

You can deactivate a device to free up a slot for a new device. Contact support if you need assistance.

7. Updates and Support

Software Updates

We regularly release updates to improve performance and add features:

• Annual licenses include updates during the subscription period
• Lifetime licenses include all future updates forever

Support

Paid license holders receive priority support via email. Free users can access community support and FAQ.

8. Disclaimer of Warranties

We do not warrant that:

• The software will be error-free or uninterrupted
• Transcription results will be 100% accurate
• The software will be compatible with all systems

9. Limitation of Liability

To the maximum extent permitted by law, sincronia.digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the software.

Our total liability shall not exceed the amount you paid for the license in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless sincronia.digital from any claims, damages, or expenses arising from your use of the software or violation of these terms.

11. Termination

We may terminate or suspend your license immediately, without prior notice, if you breach these Terms of Use. Upon termination:

• Your right to use the software ends immediately
• No refund will be provided for violations
• You must uninstall the software from all devices

12. Third-Party Components

Whisper Dictator uses the following third-party components:

• OpenAI Whisper - Speech recognition model
• whisper.cpp - C++ implementation by Georgi Gerganov
• Electron - Application framework
• FFmpeg - Audio processing

These components are subject to their own license terms.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of Brazil, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of significant changes. Your continued use of the software after changes constitutes acceptance of the new terms.

15. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in effect.

16. Entire Agreement

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and sincronia.digital regarding the software.
